Cyborg Terms of Service

Cyborg Technology, Inc. ("Cyborg," "we," or "us") provides artificial intelligence platform services to you ("User") via the website https://deepdrape.com and related technologies (collectively, the "Platform"). Use of the Platform is governed by these terms, including our Privacy Policy (https://deepdrape.com/privacypolicy) and other written agreements. By using the Platform, you confirm that you have read, understood, and agreed to be bound by these terms.

Updates to Terms
We may update these terms periodically. Continued use constitutes acceptance of modifications. If you disagree, please discontinue using the service.

1. Service Description
Cyborg generates images, videos, or other content ("Works") based on your text/style inputs ("Prompts"). You may also upload images/music/videos ("Uploaded Content") for creation. The Platform may adjust algorithms, artistic styles, and features at any time.

2. Registration Requirements
2.1 You must be at least 18 years old and legally capable of contracting.
2.2 Institutional users must be authorized representatives.
2.3 Provide accurate and complete registration information.
2.4 Account credentials must not be shared; each account is limited to one individual.

3. User Content
3.1 Definition "Content" refers to any text, information, audio, video, electronic documents, or image materials uploaded, imported, or created using the service.
3.2 License Grant You grant us a worldwide, royalty-free, sublicensable, non-exclusive license to operate and improve the service.
3.3 Ownership You retain all rights to your Content. However: Due to machine learning, different users may receive identical/similar outputs. Similar prompts/uploaded content may generate comparable Works for other users. We may use prompts/uploaded content/Works for product improvement but only use Works for marketing.
3.4 Content Sharing
3.4.1 Sharing features allow public dissemination; others may copy or modify your Content.
3.4.2 You must set access permissions.
3.4.3 User comments are non-anonymous and visible to others.
3.4.4 Deleted Content will no longer be displayed publicly, but backups may persist.

4. Usage Guidelines
4.1 Basic Requirements Comply with these terms and applicable laws. We are not liable for third-party content. We reserve the right to remove violating Content.
4.2 Prohibited Conduct Including but not limited to: Creating pornographic/violent/abusive/hate-inciting/illegal or malicious content. Reverse-engineering Platform algorithms (except where legally permitted). Data scraping/benchmarking the Platform. Removing copyright notices.
4.3 User Warranties You guarantee: Uploaded Content is legally obtained. No false information or fraud. No interference with Platform operations. No circumvention of geo-restrictions. No infringement of third-party intellectual property.
4.4 Feedback & Data We may use your suggestions without compensation and collect usage data for optimization.
4.5 Third-Party Services Third-party products are subject to their own terms.

5. Subscription Cancellation & Account Deletion
Free trials auto-renew. Cancel via app stores or website accounts; no refunds for paid amounts.

6. API Fair Use Policy
6.1 Use constitutes acceptance; we may modify terms anytime.
6.2 Limit concurrent API calls reasonably; report errors promptly. API keys must not be shared.
6.3 Abusers must compensate damages; we may suspend API access and conduct audits.
6.4 Prohibited: Illegal use, spam, malware, or reverse engineering.
6.5 Downloading/copying visual content for competitive purposes is strictly forbidden.
6.6 We reserve the right to modify or terminate API services without uptime guarantees.

7. Prohibited Activities
Including but not limited to: Illegal use, uploading infringing content, service disruption, data mining, or bypassing protections.

8. Fees
8.1 Payment Valid credit card/PayPal/Stripe required. Auto-charges require no additional authorization. Price changes will be notified via website/email. Fees are non-refundable unless otherwise stated.
8.2 Taxes You bear all taxes related to Platform use.
8.3 Termination We may terminate service for violations of community guidelines.

9. Indemnification
You will fully indemnify us (including reasonable attorney fees) for losses caused by your Platform use. We control claim defenses; no settlements may be made without our written consent.

10. Disclaimers
10.1 AI-generated images are artificial and may differ from reality.
10.2 Use at your own risk; ensure upload rights.
10.3 Absolute data security is not guaranteed.
10.4 AI-generated images are for personal reference only; no transfer of fashion design IP rights.
10.5 We are not liable for direct/indirect damages.
10.6 Service accuracy is not guaranteed; results are for reference only.

11. Liability Limitation
We are not liable for:
Service interruptions.
Replacement procurement costs.
Unauthorized data access.
Losses caused by third parties.
Total compensation shall not exceed fees paid in the past 6 months.
